0dAI Terms of Service

Contracting parts

These Terms of Service are established between:

  • 0dAI, a cyber intelligence company providing search services and pentesting tools (hereinafter "0dAI").
  • The End User, whether a free or paid user, who uses the services of 0dAI (hereinafter, "the Client").

Object of the Agreement

0dAI is committed to providing Customer with Cybersecurity AI Services (hereinafter "CSIA"), as described in this agreement. The Client agrees to pay 0dAI the corresponding fees.

0dAI's CSIA is a computer program that uses AI systems to assist in cybersecurity tasks

Paying Users

0dAI provides paying users with advanced access to CSIA data and features based on license purchased via subscription.

The CSIA will be provided on the secure website https://0dai.omegaai.io/es using a unique username and password chosen by the Client after paying the corresponding fee.

The Client must effectively protect its username and password, change the password at the request of 0dAI and prevent any misuse by its employees or third parties.

Rates

Customer agrees to pay 0dAI the annual or monthly subscription fees in advance for the license.

Fees are non-refundable, unless expressly agreed to in this agreement.

CSIA Guarantees and Limitations

No such warranty is provided with respect to the limited functionality of the CSIA.

0dAI is not responsible for any damage or harm caused by the use of its services or tools.

Pentesting Tools

0dAI offers pentesting tools upon request of the Client. Customer is responsible for using these tools legally and ethically, and for obtaining any necessary permissions before performing any penetration testing.

0dAI is not responsible for any improper use of these tools by the Client.

Privacy and Data Protection

The 0dAI Privacy Policy applies to all services and tools provided. 0dAI is committed to protecting users' personal information in accordance with applicable laws and regulations.

CSIA Maintenance and Repair

0dAI will be authorized to restrict or suspend the CSIA for maintenance and repair for the time necessary to improve the performance of the CSIA and as a result of force majeure (i.e., unavoidable and/or unforeseeable impediments to the fulfillment of 0dAI's commitment of any kind, especially natural disasters, accidents, breakdowns or interruptions and failures). 0dAI will not be responsible for any limitation or interruption of the performance of the CSIA caused by the interruption of the provision of third party services essential to the performance of the CSIA.

Maintenance and repair of the CSIA for its improvement will be notified by 0dAI to the Client in advance. Maintenance and repair of the CSIA or limitation or interruption of the performance of the CSIA caused by the interruption of the provision of third-party services will not be calculated in the guaranteed monthly accessibility of the CSIA.

Privacy and Data Use

0dAI undertakes not to track, in any way, the searches performed or the results found by the Client in the CSIA; This does not prevent 0dAI from using such anonymized data to improve the performance of the CSIA.

Limitations of Liability

0dAI will not be responsible for any defect in the provision of the CSIA resulting from non-compliance with the terms of use, in particular the minimum hardware and software configuration for the use of the CSIA by the Client, or due to improper use.

0dAI will not be responsible, in any way, for the accuracy, timeliness, completeness or correctness of any information received from the use of the CSIA. 0dAI will not be responsible, in any way, for the suitability or manner of use of the CSIA or the information received from the use of the CSIA by the Client and for the results of any action or decision taken based on the information received from the use of the CSIA.

EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, 0dAI DOES NOT OFFER NO COMMITMENT REGARDING THE INFORMATION AND CONTENT RECEIVED FROM THE USE OF THE CSIA, THE SPECIFIC FUNCTIONS OF THE CSIA OR ITS RELIABILITY, AVAILABILITY OR ABILITY TO MEET THE NEEDS OF THE CUSTOMER. 0dAI PROVIDES THE CSIA "AS IS".

Technical support

0dAI will provide paying users with technical support for CSIA performance. 0dAI is committed to providing online support within 7 days of receiving notification related to CSIA malfunction or nonperformance.

Other Client Obligations

The Customer shall ensure the conditions for the operation of the CSIA at its own expense, i.e. in particular meeting the minimum technical and connectivity requirements of the CSIA and the hardware performance with respect to the amount of data transferred.

The Client acknowledges that non-use and non-use of the CSIA will not entitle the Client to any compensation, refund, discount or reduction of fees or refund of any service.

The Client is solely and fully responsible for the legality of its use of the CSIA and the information received from the use of the CSIA.

By using the CSIA, the Client does not receive any ownership or rights to use any intellectual property of the CSIA or information received from the use of the CSIA. This agreement does not grant the Client the right to use any trademark or logo used in the CSIA.
